Services provided by electronic means
- The Seller provides the following services in the Shop free of charge:
- an Account,
- the order form (also without creating an Account),
- the contact form,
- a newsletter – sent only with consent,
- publishing Product reviews,
- an e-mail alert when a Product is back in stock.
- Conclusion and termination of the contracts for each service:
- Account – the contract is concluded on registration, for an indefinite period. The Customer may terminate it at any time without giving a reason by asking for the Account to be deleted at [email protected].
- Order form – the contract is concluded when the Customer starts filling in the form and ends when the order is placed or the Customer stops placing it.
- Contact form – the contract is concluded when the message is sent and ends when it is answered.
- Newsletter – the contract is concluded when the Customer subscribes in the newsletter form or ticks the newsletter consent at registration. It is concluded for an indefinite period; the Customer may terminate it at any time by unticking the newsletter consent in the Account details or by writing to [email protected].
- Back-in-stock alert – the contract is concluded when the Customer signs up for an alert on the page of an out-of-stock Product and ends once a single message about the Product being back in stock has been sent. The Customer may terminate it earlier by removing the alert in the Account (My alerts) or by writing to [email protected].
- Product reviews – a review can be added by a Customer signed in to an Account. The contract is concluded when the review is submitted and ends when it is deleted. The Customer may ask at any time for their review to be deleted by writing to [email protected].
- To use the Shop you need a device with internet access, an up-to-date web browser with cookies and JavaScript enabled, and an active e-mail address.
- Customers must not supply unlawful content, in particular in the contact form and in reviews.
- Using the internet involves typical risks such as malware and phishing. The Seller never asks for your Account password or online banking login details. We recommend up-to-date antivirus software and strong passwords.
- Complaints about electronic services can be sent to [email protected]. The Seller replies within 14 days.
Product reviews
- Only Customers signed in to an Account can add reviews. Each review is published only after the Seller has checked that it contains no unlawful content or content unrelated to the Product.
- The Seller does not check whether the author of a review bought or used the Product reviewed. Reviews may therefore also come from people who did not buy the Product in the Shop.
Placing orders
- Orders can be placed 24 hours a day as a guest or after signing in to an Account.
- To place an order, add Products to the cart, enter delivery details (and invoice details if needed), choose a delivery and payment method, accept these terms and confirm the order with the button marked as an order with an obligation to pay.
- Before placing the order the Customer sees the total price of the Products including taxes and the delivery costs.
- Placing an order is an offer to conclude a Sales contract. The contract is concluded when the Customer receives the e-mail confirming that the order has been accepted. The e-mail contains the order number, the Products ordered, the prices, the delivery costs and the chosen delivery and payment methods.
- These terms, including the information on the right of withdrawal and the model withdrawal form, are available in the Shop in a form that can be downloaded, saved and printed.
Prices
- Prices in the Shop are given in Polish zloty (PLN) and include VAT. Delivery costs are shown separately before the order is placed.
- Whenever we announce a price reduction, we also show the lowest price of the Product in the 30 days before the reduction.
- The Seller does not personalise prices on the basis of automated decision-making.
Payments
- The payment methods available are shown during checkout:
- bank transfer to the Seller's account no. PL00 0000 0000 0000 0000 0000 0000 – within 7 days of placing the order, quoting the order number as the payment reference,
- cash on delivery – in cash or by card where the carrier allows it,
- online payments (instant transfer, BLIK, payment card) handled by an external payment operator.
- If a prepaid order is not paid within the set time, the Seller may set an additional deadline and, if it passes without payment, withdraw from the contract.
Delivery
- We deliver within Poland. The available carriers and delivery costs are shown in the cart, at the latest at the start of checkout.
- The order lead time is the dispatch time shown with the Product plus the carrier's delivery time. Unless agreed otherwise, the Seller delivers the Product to a Consumer no later than 30 days after the contract is concluded.
- More information is on the Delivery page.
Right of withdrawal
- Consumers and sole traders with consumer rights may withdraw from a Sales contract within 14 days without giving any reason.
- The withdrawal rules, return costs, exceptions and the model withdrawal form are on the Withdrawal, returns and complaints page.
Product complaints
- The Seller is liable to Consumers and sole traders with consumer rights for any lack of conformity of a Product with the contract that exists when it is delivered and becomes apparent within two years of delivery, unless the period for which the Product remains fit for use, as specified by the Seller, its legal predecessors or persons acting on their behalf, is longer. The Seller cannot rely on the expiry of this period if it fraudulently concealed the lack of conformity.
- If a Product does not conform with the contract, the Customer may request repair or replacement and, in the cases provided for by law, declare a price reduction or withdrawal from the contract.
- Complaints can be sent by e-mail to [email protected] or by post to Splot – sklep demonstracyjny, ul. Przykładowa 1, 00-001 Warszawa, Poland. The Seller replies within 14 days of receipt, on paper or another durable medium (e.g. by e-mail). If the Seller does not reply within that time, the complaint is deemed accepted.
- The full complaint rules are on the Withdrawal, returns and complaints page.
Out-of-court dispute resolution
- Consumers may obtain free help from a municipal or district consumer ombudsman (rzecznik konsumentów) and use mediation or the permanent arbitration court at the regional inspector of the Trade Inspection (Inspekcja Handlowa).
- The register of bodies authorised to resolve consumer disputes out of court is kept by the President of UOKiK: polubowne.uokik.gov.pl. Information on help for consumers: prawakonsumenta.uokik.gov.pl.
- Out-of-court dispute resolution is voluntary and requires the consent of both parties.
Sole traders with consumer rights and other Customers
- The rules on withdrawal and on liability for the conformity of Products with the contract also apply to sole traders with consumer rights.
- If the contract does not show whether it is of a professional nature for such a person, they may declare, at the latest when the contract is concluded, that it is or is not of a professional nature for them. The Seller does not make the contract conditional on such a declaration.
- For Customers who are neither Consumers nor sole traders with consumer rights, the Seller's liability under the statutory warranty (rękojmia) is excluded.
Personal data
The processing of personal data and the use of cookies are described in the Privacy policy.
Final provisions
- These terms are available free of charge in the Shop before the contract is concluded, in a form that can be downloaded, saved and printed.
- The Seller may introduce a new version of these terms. The new version applies to contracts concluded from the date it takes effect and does not change sales contracts or Account contracts concluded earlier.
- A change to the terms of an existing Account contract requires the Customer's consent, except for changes that follow directly from mandatory provisions of law.
- Matters not covered by these terms are governed by Polish law. This choice of law does not deprive a Consumer of the protection given by the mandatory provisions of the law of their country of habitual residence.
- Nothing in these terms limits a Consumer's rights under mandatory provisions of law.
